Terms & Conditions – M² Muslim Smartwatch
1. Disclaimer
1.1 General Use
The M² Muslim Smartwatch (the “Product”) is designed to enhance daily life by integrating innovative technology with lifestyle and religious values, including prayer alerts, Qibla direction, and wellness tracking. The Product is not a medical device. Health metrics such as step count, heart rate, and sleep tracking are provided for informational purposes only and should not be relied upon for medical diagnosis or treatment.
1.2 Limitations
M² Muslim Smart Wearable (the “Company”) shall not be liable for any inaccuracies, errors, or omissions in the Product’s features, including prayer time notifications, Qibla direction, or health tracking data. Users should verify critical information independently when needed.
2. Warranty
2.1 Coverage
The Company warrants that the Product will be free from defects in materials and workmanship under normal use for a period of twelve (12) months from the date of original retail purchase (the “Warranty Period”).
2.2 Exclusions
This warranty does not cover:
- Damage resulting from misuse, accidents, unauthorized repairs, or modifications.
- Normal wear and tear, including battery degradation, cosmetic scratches, or strap wear.
- Use of non-approved accessories or third-party software.
2.3 Remedy
In the event of a valid warranty claim, the Company will, at its sole discretion, repair or replace the defective Product or component at no additional cost.
3. Delivery
3.1 Processing & Shipment
Orders will be processed and shipped within seven (7) to fourteen (14) business days from confirmation of payment, subject to stock availability.
3.2 Pre-Orders
For pre-order purchases of the M² Muslim Smartwatch, delivery is expected to commence by 30th November 2025. The date are estimates and may be adjusted due to production schedules, logistics, or unforeseen circumstances. Customers will be notified of any material changes to the expected delivery timeline.
3.3 Local Delivery
For customers located in Malaysia or the Kingdom of Saudi Arabia, the Company will provide local delivery services through designated courier partners. Local delivery typically takes 3 to 7 business days from dispatch, subject to courier availability and public holidays.
3.4 International Shipping
For orders outside Malaysia and Saudi Arabia, delivery times may vary depending on destination and customs clearance. Customs duties, import taxes, and any government fees are the responsibility of the purchaser.
3.5 Delays
The Company shall not be liable for delays caused by events beyond its reasonable control, including transportation issues, customs clearance delays, or natural disasters.
3.6 Risk of Loss
Risk of loss or damage passes to the purchaser upon delivery to the carrier. Title transfers upon full payment receipt.
4. Limitation of Liability
4.1 Exclusion of Damages
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising from the use or inability to use the Product, even if the Company has been advised of the possibility of such damages.
4.2 Liability Cap
The Company’s total aggregate liability for any claims shall not exceed the purchase price actually paid for the Product giving rise to the claim.
4.3 Mandatory Legal Rights
Nothing in these Terms & Conditions shall exclude or limit liability which cannot be excluded under applicable law, including death or personal injury caused by gross negligence or willful misconduct.
5. Data Protection
5.1 Personal Data Collection
The Company collects personal data including name, contact information, location data (for religious features), and device usage information in accordance with applicable laws such as the Malaysia Personal Data Protection Act 2010 or relevant Saudi regulations.
5.2 Use of Data
Data is used for:
- Order processing and product delivery
- Warranty and customer support
- Product updates, alerts, and communications
5.3 Data Sharing
Data may be shared with service providers only as necessary to fulfill orders or provide customer support. The Company does not sell personal data.
5.4 Data Security
The Company implements reasonable technical and organizational measures to protect data against unauthorized access, loss, or misuse.
5.5 User Rights
Purchasers may access, correct, or request deletion of their data by contacting the Company’s Data Protection Officer.
6. Governing Law & Jurisdiction
Option A – Malaysia
These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia.
Option B – Saudi Arabia
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes shall be submitted to the exclusive jurisdiction of competent Saudi courts.
7. Severability & Entire Agreement
7.1 Severability
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7.2 Entire Agreement
These Terms & Conditions constitute the full agreement between the Company and purchaser, superseding prior agreements.
8. Additional Provisions
8.1 Intellectual Property
All Product design, logos, trademarks, and software are the exclusive property of the Company.
8.2 Force Majeure
The Company shall not be liable for failure to perform due to events beyond its reasonable control, including natural disasters, wars, or government actions.
8.3 Updates to Terms
The Company may update these Terms & Conditions at any time. Updated terms will be communicated through the website or app and will apply to all subsequent orders.
